What doesn't add up
No brand is perfect. These are the concerns and complaints we've found from independent sources.
In ChromaDex v Elysium (No. 22-1116), Judges Prost, Chen and Stoll affirmed that U.S. patent 8,383,086 covering isolated nicotinamide riboside is invalid as a product of nature under 35 U.S.C. §101, ending Dartmouth/ChromaDex's exclusive control over the ingredient Elysium chose to license itself and then substitute after the licensing dispute.
In ChromaDex v Elysium Health (SACV 16-02277-CJC), the court let ChromaDex's breach-of-contract claims on the pTeroPure and NIAGEN supply agreements survive and let Elysium's counterclaims for fraudulent inducement against ChromaDex founder Frank Jaksch and for patent misuse survive summary judgment. The trade-secret story on both sides is unresolved, not endorsed.
In the consolidated Elysium Health-ChromaDex litigation (17-cv-7394), the court granted summary judgment for Elysium on the injury element of ChromaDex's Lanham Act false advertising claim, dismissing ChromaDex's complaint in full. Several of Elysium's counterclaims against ChromaDex's advertising also survived. The case is a mutual-injunction record, not a clean win for either side's marketing.
Basis is 250 mg nicotinamide riboside plus 50 mg pterostilbene per two-capsule serving, at roughly USD 40 to 60 per month. The only human trial of the exact NRPT formula (Dellinger et al., NPJ Aging 2017, N=120) was funded by Elysium and reports a NAD+ biomarker rise, not a clinical outcome. No head-to-head trial has shown that adding pterostilbene to NR beats plain NR on any hard endpoint.
NAD ruled that Elysium had reliable evidence Basis raises whole-blood NAD+ in 40 to 60 year olds, but recommended Elysium make clear that any noticeable aging-related benefits of Basis or its ingredients has not been shown in humans. Elysium agreed to comply.
